Terms & Conditions

CONDITIONS OF HIRE

MAISON PASTEUR JUNE 2002

  1. The hiring shall be between the client and the owners of the property and shall be made subject to these conditions of hire.

  2. Payments, confirmation of booking and cancellation shall be as detailed on the booking form and on the website or as otherwise agreed in correspondence between the owners and the client.

  3. The deposit payable on booking is accepted as part payment of the total holiday cost.  The balance of the total must be paid to the owners not less than eight weeks before departure.

  4. A security deposit of £200, is payable by the client with the balance of the total cost.  This deposit is held by the owners against any damage, breakage or loss, which occurs during the period of the holiday and will be returned to the client, minus any sums claimed by the owner, within two weeks of the end of the holiday except in instances where local estimates or accounts are awaited.

  5. Where outstanding balances are not paid on time the owners will remind the client of the outstanding amount.  Failure to pay by return may lead to the owners cancelling the booking and retaining any deposit paid to that date.

  6. All cancellations must be confirmed in writing by post or by email and is not effective until received and confirmed by the owners.

    Between 4 and 8 weeks before departure  50% of total rental
    Less than 4 weeks before departure   100% of total rental


  7. No contract shall exist between the owner and a client until a signed booking form or an emailed booking form has been received by the owners and they have confirmed that booking to the client.

  8. The use of the accommodation, pool and other facilities provided is entirely at the user's own risk and no responsibility can be accepted for injury or loss or damage to motor vehicles and/or loss of contents.  The clients, by making the booking confirm that they have seen the property description on the website and have read and understood the House Manual, including the various safety warnings.  We accept responsibility for any acts of negligence on the part of our agents.

  9. Under no circumstances may more than the stated number of persons occupy the property, unless otherwise agreed by the owners in writing.  The owners reserve the right to terminate the contract if the property is occupied by any unauthorised person/s.  The client and party acquire no rights whatsoever over the property except to occupy it for the agreed period as a holiday let.  The client may not sub-let the property.

  10. In addition, the owners reserve the right to refuse or revoke (before or during the holiday) any bookings from parties which may in the sole opinion of the owners be unsuitable for the property or who may cause unacceptable disturbance/behaviour to the local residents in Maureilhan.

  11. The client is responsible for the property during the hire period and is expected to take all reasonable care of it.  Although the owners will arrange for the property to be cleaned at the end of the hire period the clients must ensure that all equipment and utensils are left clean and the property must be left in a reasonably clean and tidy condition.

  12. The client undertakes to lock all doors, windows and security grilles when leaving the property unoccupied.

  13. All damages and breakages are the legal responsibility of the hirer and their cost shall be covered from the security deposit or from the hirer if that amount proves insufficient.  Minor breakages such as plates and glasses should be replaced.  The owners have provided spare light bulbs etc and these minor items will not be charged.

  14. Any other loss or damage to the property or its contents should be reported to the owners or their local agents at the time of occurrence.  You are fully liable for the cost of any such damage which needs to be undertaken promptly to minimise the inconvenience for incoming clients.

  15. The owners have made every effort to ensure that information given to you via the website and email is correct.  All information with regard to the property, its contents and services are given in good faith and are believed and intended to be accurate.  The owners will not, however, be liable for any inaccuracies.

  16. The owners particularly ask to care for the property and contents as you would your own home and belongings.  If the property is deemed by our agent to untidy, dirty or with undue amounts of undisposed rubbish the cleaning charge will be deducted from the deposit.

  17. Any complaints about the property or its contents or facilities must be made, where practicable, within 24 hours of the complaints arising, either to the owners or to their agent.

  18. Any claim should be made to the owners within 14 days of the end of the holiday period.

  19. It must be understood that this property may have inherent dangers such as the swimming pool, stone walls, staircases, windows and access to roads.  The steps taken by the owners to minimise these risks are detailed on the website and the house manual BUT the owners cannot be responsible or accept liability for accidents however they may occur as clients themselves must be responsible for themselves and their party while on the property.  No claims of any sort will be considered for incidents that occur while those affected are under the influence of alcohol or illegal substances.

  20. The rental period shall commence at 1600 hours on the first day and finish at 1000 hours on the last day.  The owner shall not be obliged to provide accommodation before or after these times.  It may, however, be possible to provide an earlier entry or later departure by agreement at the time of booking.

  21. The owner shall not be liable to the client for: temporary stoppage or defect in the supply of public/utility services to the property, nor in respect of any equipment, plant machinery or appliance in the property, garden or swimming pool for any loss/damage or injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the owner or for any loss, damage or inconvenience caused to or suffered by the client if the property shall be destroyed or substantially damaged before the start of the rental period.  In such event the owner shall, within 14 days of notification by the client, refund to the client all sums paid in respect of the rental period.

  22. Under no circumstances will the liability of the owner exceed the total cost of the holiday period.

  23. Pets may be brought onto the property only with the prior permission of the owners.

  24. This contract shall be governed by English law and any proceeding arising therefrom shall be brought to an appropriate court in England.
